BREAKING NEWS, Nov. 5, 12:20 p.m.⎯GOOD Morning Wilton just received a press release from the lawyer of a family that has just filed suit against the town of Wilton and the Wilton Bd. of Education, alleging their daughter was sexually abused by former preschool aide Eric von Kohorn while in the school. We are printing the press release as it was sent to us although it’s important to note that it refers to the director of preschool services Dr. Fred Rapczynski as principal of Miller-Driscoll; he is not the M-D principal. (Editor’s note: any emphasis or bolding is GMW’s):
“A Wilton family has filed a lawsuit against the Town of Wilton and Wilton Board of Education, alleging their daughter was sexually abused by in [sic] the Miller-Driscoll School by school paraprofessional, Eric von Kohorn. The suit alleges von Kohorn sexually assaulted the preschool student in a school bathroom during the 2012-13 school year.
“Von Korn, [sic] a former preschool aide at Wilton’s Miller-Driscoll School who had close daily contact with preschool students, was sentenced last week after pleading guilty to possession of child pornography second degree. Von Kohorn was arrested in August 2014, while still an employee working in the Miller-Driscoll School, a fact that led to significant community concerns and at least one public meeting with School Superintendent Dr. Kevin Smith and local authorities about his involvement with children in the Wilton Public Schools. Von Kohorn’s lawyers repeatedly have stated to the media that von Kohorn is “not a child molester” and has “never touched a child” — statements this lawsuit directly challenges.
“The family is represented by Paul Slager and Mike Kennedy of Silver Golub & Teitell in Stamford. Paul Slager has represented victims of some of Connecticut’s most notorious crimes in civil cases, including:
- the family of the murdered Yale graduate student, Annie Le;
- the victim of a violent home invasion and sexual assault at the Willow Springs condominium complex in New Milford;
- three victims who were robbed and violently sexually assaulted in the Stamford Marriot parking garage; and,
- multiple survivors of sexual abuse in Boy Scout activities, including a man who was awarded a record-setting jury verdict against Boy Scouts of America in December 2014 for sexual abuse suffered at the hands of New Fairfield Boy Scout leader Siegfried Hepp, later convicted of a felony charge of risk of injury to a minor.
“The family’s lawsuit alleges that in January 2013 von Kohorn “inappropriately touched, sexually assaulted and battered” a four-year-old Miller-Driscoll School preschool student during the school day in a school bathroom causing visible injury to her genital area. The lawsuit further claims the girl’s parents informed Miller-Driscoll Principal, Dr. Fred Rapczynski, of their daughter’s visible physical injuries in January 2013 and that Dr. Rapczynski violated his legal obligation to report the allegation to DCF within 12 hours, instead waiting four days before making the legally mandated report.
“The complaint also claims that Dr. Rapcynski [sic] submitted a signed report to DCF indicating von Kohorn admitted taking the girl to the bathroom, but then separately informed the girl’s parents that his investigation concluded just the opposite: that von Kohorn had never taken the girl to the bathroom at all. Based on Rapcynski’s false representations, the suit alleges, the girl’s parents permitted the student to have further contact with von Kohorn, which caused her additional trauma.”
